McKellar is the only structured settlement firm in Canada with a full-time Legal Department that currently includes four lawyers.

Structures are governed by Canadian tax law, so it is critical that settlement documents for every structure established conform with Canada Revenue Agency (CRA) requirements, as set out in the original Interpretation Bulletin IT-365R2 and related tax rulings. As a result, documents relating to structures are very different from those used in cases involving lump-sum settlements.

Our Legal Department protects you and your settlement by ensuring that all necessary documentation complies with CRA requirements. Specifically, we: 

• Assist with the preparation and review of all structure aspects of draft settlement documents for every jurisdiction in Canada;

• Prepare and verify Assignment Agreements, structure applications and contracts to confirm that these also comply with the requirements of CRA and the terms of each settlement; and

• Confirm the structure compliance of executed Releases and issued/filed Judgments and Orders.

Only when these steps have been completed do we issue the McKellar Guarantee - our seal of structure compliance and quality.
