McKellar Code of Conduct

McKellar fosters an environment of honesty and ethical behaviour within the company.

McKellar will always deal with its clients in utmost good faith. If McKellar is aware of a potential conflict of interest, its clients will be advised.

McKellar undertakes to protect the privacy of its clients and will fully comply with the requirements of all applicable privacy legislation.

McKellar warrants that no rebates, secret commissions or fees of any kind have been paid or will be paid to any lawyer, claimant, casualty insurer or defendant involved with the settlement. Nor will McKellar “front” for another broker or financial institution.

McKellar is a completely independent Canadian structured settlement broker. McKellar is not affiliated with any casualty insurer, defendant or life insurer involved in the settlement.

McKellar is contracted with all major life insurers in Canada in the structured settlement market: BMO Life Assurance Company, The Canada Life Assurance Company, and Sun Life Assurance Company of Canada.

McKellar will complete an exhaustive brokerage in order to obtain the highest yield possible, under the terms of the settlement, at the time of funding the structured settlement.

McKellar does not charge any fees for its services. It is paid by way of a commission from the life insurer(s) issuing the structured settlement. The commission is based on a percentage of the amount structured, as well as the total volume of business placed by the broker. Commission scales are the same for all brokers in Canada. McKellar has confirmed with all major life insurers in Canada in the structured settlement market that they will not provide any other broker with a better structure yield or better medical underwriting.

McKellar undertakes to comply with all relevant federal, provincial and local regulatory agencies. McKellar agents are licensed to sell life insurance products as required by law. McKellar is insured to a level (including errors and omissions insurance) which meets or exceeds all provincial and federal requirements.

McKellar’s Legal Department will review and assist with the settlement documentation provided to us to ensure 100% income tax compliance.

McKellar will issue The McKellar Guarantee that the structured settlement complies with all tax requirements for tax-free status; that appropriate brokerage has been undertaken; and that the terms of the annuity conform to the specifications of the settlement documentation approved by us.
