Precedent Settlement Documents
McKellar is happy to provide appropriate precedent settlement documents for particular cases. We have several hundred different precedent documents available. Some of the factors which we consider in deciding which are appropriate in a particular case are as follows:
- Jurisdiction
- Age of Plaintiff (minor / adult)
- Mental Competence
- Type of Claim (tort / tort and accident benefits combined / accident benefits)
- Date of Loss (for Ontario accident benefits claims determines applicable accident benefits regime)
- Ownership (one casualty insurance company or more than one)
- Identity of Casualty Company(ies) (some have special requirements)
- Assignment
- Secondary Payee (person to receive payments after death of plaintiff - named individual / estate / right to name individual later)
- Reversion (full / partial)
- Payment Commencement Date for Minors (before majority / at or after majority)
- Number of Life Insurance Companies Funded For Structure
